General terms and conditions

1. Scope

These terms apply to all orders placed via this website. They are addressed to two groups:

  • consumers within the meaning of § 13 BGB (German Civil Code) who order via the sales page,
  • businesses within the meaning of § 14 BGB, in particular barbershops, that order via the partner area.

Rules that apply to only one group are marked “Consumers only” or “Businesses only”. Deviating terms of businesses apply only if we expressly agree to them in writing.

2. Conclusion of the contract

The presentation of the product on the website is not yet an offer but an invitation to order. By submitting the order form with the button “Pre-order with obligation to pay” (“Zahlungspflichtig vorbestellen”; partner shops: “Order starter pack with obligation to pay”, “Startpaket zahlungspflichtig bestellen”) you make a binding offer. Before you submit, the form shows a summary with quantity, price, shipping costs and total amount. Up to that point you can correct all entries directly in the form.

Immediately afterwards you receive an email confirming receipt of your order. The contract is concluded when we accept the order: by an express acceptance in the confirmation email or at the latest by sending the invoice. If you pay with PayPal, the contract is concluded as soon as you approve the payment at PayPal and we confirm it.

3. Pre-order and delivery time

RAUHBEIN Beard Oil is a pre-order item. Shipping starts after the tour begins on 23 October 2026. We state the date by which we will deliver at the latest on the product page directly at the order button and in the order confirmation (PLATZHALTER: specific date).

Consumers only: If we have still not delivered more than 30 days after the announced latest delivery date, you can withdraw from the contract without first having to set us a further deadline. We will then refund any amounts already paid without undue delay. Your statutory rights in the event of late delivery remain unaffected.

4. Prices and shipping

Consumers only: RAUHBEIN Beard Oil 500 ml costs €149.90 including 19% VAT (unit price €29.98 per 100 ml). Shipping costs of €4.90 per order are added.

Businesses only: The prices displayed in the partner area after entering the partner code apply. They are net prices plus statutory VAT.

5. Payment

You can choose between two payment methods in the form:

  • Payment in advance by bank transfer: You receive an invoice by email. Please pay within 7 days of the invoice date. If no payment has been received by then, we may cancel the order; we will let you know by email beforehand.
  • PayPal: You are redirected to PayPal and pay there immediately.

Businesses only: The purchase price is due upon ordering.

6. Delivery

Consumers only: We deliver exclusively to addresses in Germany.

Businesses only: We deliver to the business address provided in Germany. The risk passes to you upon handover to the shipping company.

7. Retention of title

The goods remain our property until paid for in full. Businesses only: You may resell the goods in the ordinary course of business. You hereby assign to us the claims arising from the resale in the amount of our invoice total; we accept the assignment.

8. Warranty

The statutory law on liability for defects applies. Businesses only: Please notify us of obvious defects within 7 days of receipt (§ 377 HGB, German Commercial Code); the limitation period for claims for defects is one year from delivery, except in cases of intent, gross negligence and injury to life, body or health.

9. Right of withdrawal

Consumers only: You have a statutory right of withdrawal. The details are set out in the withdrawal policy.

Businesses only: There is no right of withdrawal for orders placed in the partner area. By ordering, you confirm that you are acting as a business.

10. Special provisions for partner shops (businesses only)

  • Minimum order: An order comprises at least 4 bottles.
  • Partner code: The code is intended for your shop and may not be passed on.
  • Territorial exclusivity: From receipt of your payment, we will not supply any other barbershop as a partner within a radius of 25 km of your business address. The territorial exclusivity applies for PLATZHALTER 12 months. It concerns only partner barbershops, not our own sales to consumers via this website or at concerts.
  • Event day: An event day with Henry in the shop is only possible in tour cities and is agreed on a case-by-case basis. Outside the tour cities there is no entitlement to it.

11. Storage of the contract text

We store your order data and send it to you with the confirmation email. You can access and print these terms and conditions on this page at any time. There is no customer account in which you can view previous orders.

12. Contract language

The contract is concluded in German.

13. Applicable law and place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers only: This choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the law of the state in which you have your habitual residence.

Businesses only: If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is the registered office of TM Merch GmbH.

14. Severability

If any provision of these terms and conditions is invalid, the remaining provisions remain valid. The statutory provision takes the place of the invalid provision.
